A partner taking a commission on each deal he buys

Question:

I am doing real estate business with a foreigner who is the investor. 70 % of the profit goes to the investor and the balance 30 % for me. I buy land thru the brokers. The land owners give a commission of 3% to the brokers. I get 1.5% from the brokers. Is it halal for me to take the commission without asking the investor or shall I share it with the investor?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

You cannot take this commission - which you take from the broker - for yourself and not for your partner; rather, it should be added to the money of the company because you did not buy (land) for yourself but you bought (it) for the company and the commission is due to that.
