He works in a company and takes commissions from its clients

Question:

Assalamu Alaikum W.W respected Hazarath. I want know some clarification? 1. I am working in a company and doing a part time business which is completely aware from our business is it permissible? 2. I am working in a company and i got a contract, which our company do not agree because of low rate, so now can i give this to another company and take a commission? 3. I am working in a company and do purchasing for it and i get a commission from seller for doing business with them is it permissible? 4. Can i find a job when working in different company because they do not pay me a good package? Please help me to sought out my problem?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

Your question included four matters:

1- Running a business that is different from your work in the company: It appears that you do that for your own benefit. If you are doing so during your working hours, it is not permissible unless a person who is in authority to give permission in your company gives you permission to do so. But if this activity is done outside your working hours, then this is permissible.

2- Offering another company the deal that your company refused in return for commission: This is related to the first question. If this is done during your working hours, then it is not permissible and if it is outside your working hours, it is permissible.

3- It is not permissible for you to take a commission or anything else from the sellers, and the gifts which they give you, you are not entitled to take them for yourself; rather, you are obliged to give them to your employers. If they allow you to take them, you may do so, otherwise they [gifts, commission, etc…] belong to the company and not to you as we have previously clarified in Fatwa 89483.

4- There is no harm in you looking for work outside of your working hours or even during your working hours if you have a written or customary consent from your employer. But you should know that employment contracts are binding to both parties throughout the period of the contract. So, neither party can terminate it without the consent of the other party.
