Leasing in Islam

Question:

Is leasing allowed in Islam?

Answer:

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

Leasing, renting out, or hiring are lawful according to the Quran and the Sunnah.

Allah Says (what means):

• {And if they breastfeed for you, then give them their payment and confer among yourselves in the acceptable way.} [Quran 65: 6]

• {One of the women said, "O my father, hire him. Indeed, the best one you can hire is the strong and the trustworthy."} [Quran 28: 26]

Abu Hurayrah  may  Allaah  be  pleased  with  him narrated that the Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) said: “Allah Said: 'I will be an opponent to three types of people on the Day of Resurrection:

1. One who makes a covenant in My Name, but proves treacherous;

2. One who sells a free person and eats his price; and

3. One who employs a laborer and takes full work from him but does not pay him for his labor'”.

The Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) also hired a man from ad-Dayl tribe to show him the way to Medeenah when he migrated from Makkah with the companion Abu Bakr  may  Allaah  be  pleased  with  him.

In addition, all scholars are agreed on this ruling. Ibn Qudamah  may  Allaah  have  mercy  upon  him said: "All the people of knowledge from all regions and in all times agree that leasing is lawful. The only exception is what is reported from Abdurrahman Ibn al-Assam who said that leasing is unlawful because it is an aleatory contract." [End of quote]

But the correct opinion is that leasing is lawful.
