Her husband takes loans from usurious banks

Question:

asslam alikum. my husabnd takes loans from the bank with intersts , I keep telling him that this is haram and I don't like you to do it, but he says no it not and keep on doing it, my question is will I punished from Allah because I'm living with him, and do You advice me to ask him for divorce. I am also working and try not to use his money becasue it is not halal, jazak Allah khair.

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

 

First of all, we thank you for holding your husband to account, enjoining him to do good and forbidding him from evil. Your matter is that of the believing women of the Salaf (righteous predecessors)  may  Allaah  have  mercy  upon  them who used to advise their husbands when they go out by telling them: "O so and so, fear Allaah, do not feed us what is forbidden as we can tolerate on hunger but we cannot tolerate the punishment of Hellfire." Therefore, you should continue advising him as Allaah may guide him and he might repent.

On the other hand, you are not sinful for what your husband is doing as Allaah Says (what means): {…and no bearer of burdens will bear the burden of another.}[Quran 6:164]. We also advise you not to ask him to divorce you, rather you should continue advising him and calling him to Allaah. For more benefit, please refer to Fatwa 88833.

As regards accepting his provision for you because they are originated from loans with Ribaa (interest and usury) then the matter depends on the ruling of taking one's right from the money of a person who obtained it from a forbidden contract like Ribaa and the like, as the scholars  may  Allaah  have  mercy  upon  them have different opinions about the issue. The preponderant opinion in our view is that the liability of the money which one obtained from forbidden sources falls on the one who obtained such money and the money is not in itself the problem. Therefore it is permissible for you to take your provision from this money; this is of course if we presume that all his money is forbidden, but if his money is mixed from lawful and unlawful sources, then the matter is much easier and more relaxed.
