Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that none is worthy of worship except Allah and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and messenger.

As we stated in the previous Fatwa, if the Bid‘ah that he is practicing takes the doer out of the fold of Islam, it is prohibited for you to stay in marriage bond with him or to allow him to have sexual intercourse with you.

What he is describing as “Waseela” (an intermediary means) is not a legitimate means; rather, it involves Shirk (associating partners with Allah in worship). His statement is just like that of the polytheists of the Quraysh. Quoting them in the Quran, Allah Said (what means): {“We only worship them that they may bring us nearer to Allah in position.”} [Quran 39:3]

The fact that these men are righteous and pious does not justify taking them as mediators, calling upon them for help, or seeking relief through them apart from Allah The Exalted.

Regarding prayer, as we have previously mentioned; it is an independent act of worship prescribed by the Sharee’ah just as Zakat is an independent act of worship prescribed by the Sharee’ah. They cannot substitute one another.

Our advice for you is to seek the help of someone to make the truth clear to him in this regard, especially concerning the creed-related matter. If he repents, then all praise be to Allah; if not, then it is unlawful for the two of you to stay together as husband and wife as long as he holds on to that corrupt belief. You do not have a choice in this regard; Allah The Exalted Says (what means): {It is not for a believing man or a believing woman, when Allah and His Messenger have decided a matter, that they should [thereafter] have any choice about their affair} [Quran 33:36]
