Salam alykum..My fiancée and I are planning our Nikah next month, InShaa Allah. She has chosen her Mahr to be that I take her for Umrah, but due to work we can only travel in November. My question is, after our Nikah, but before I fulfill the Mahr by taking her for Umrah, is she considered my lawful wife according to the Sharia, with all marital rights and obligations, including intimacy?
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad
is His slave and Messenger.
If the nikāḥ is conducted and concluded, fulfilling all its essential elements – such as the offer and acceptance, the guardian (walī), and the witnesses – then the nikāḥ is valid, and the girl will Islamically be considered your wife. Consequently, whatever is permissible for a husband with regard to his wife will be permissible for you as well.
However, we would like to mention that there is a difference of opinion among the jurists regarding making Hajj or ʿUmrah the mahr (dowry). Some of the jurists considered it permissible, whilst others did not and deemed it invalid; according to this latter opinion, the woman would be entitled to the same dowry as other brides of the same social status like her.
Allah Knows best.
